End User License Agreement

This End User License Agreement (“EULA”) is between even8 and you and applies to even8 web, desktop, mobile, browser-extension, integration, update, and related software (“Software”). By installing, accessing, or using it, you accept this EULA. A signed agreement with your organization controls if it conflicts.

Subject to this EULA, the Terms of Service, and payment obligations, even8 grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license during the subscription term to use the Software on supported devices solely for your organization’s internal business purposes.

The Software is licensed, not sold. even8 and its licensors retain all rights in it and related intellectual property. No rights are granted except those stated. Open-source components are governed by their applicable licenses.

The Software may automatically check for, download, and install security, compatibility, or feature updates. Some functions require internet access and connection to hosted Services. We may discontinue support for outdated versions after reasonable notice where practicable.

The Software may connect to or include third-party components. Their terms govern their services, and those providers are responsible for them. even8 is not liable for third-party services or availability changes.

The Software may process account, configuration, workspace, diagnostic, crash, performance, device, and usage information to authenticate you, provide functionality, maintain security, and improve reliability. Our Privacy Policy explains these practices. You must have authority to submit or connect data.

Beta, preview, or early-access features may be incomplete, change without notice, and have additional terms. Non-public Software, documentation, and features reasonably understood as confidential must be protected and used only to evaluate or use the Software.

This license ends automatically when your subscription or authorization ends or if you materially breach this EULA. You must then stop use and delete installed copies. Ownership, restrictions, disclaimers, liability, and general terms survive as applicable.

To the maximum extent permitted by law, the Software is provided “as is” and “as available,” without implied warranties of merchantability, fitness, non-infringement, or uninterrupted operation. Event data, matches, scores, summaries, and AI-assisted outputs may be incomplete or inaccurate and require human review.

To the maximum extent permitted by law, even8 and its licensors are not liable for indirect, special, incidental, consequential, exemplary, or punitive damages, or lost revenue, profits, goodwill, or data. Aggregate liability under this EULA will not exceed the amount paid for the Software during the 12 months before the claim. Nothing limits liability that cannot legally be limited.

You must comply with trade controls, sanctions, and export laws and may not transfer the Software to prohibited destinations, entities, or persons. Government users receive only the rights customarily provided to commercial users under this EULA.

This EULA, Terms of Service, Privacy Policy, and order form are the complete agreement for the Software. An unenforceable provision is limited to the minimum necessary. Governing law and venue follow the order form or Terms. We may update this EULA for future versions or on reasonable notice; continued use after the effective date is acceptance where law permits.
